‘Rokersdiscriminatie mág’

Een Engels parlementslid stelde de de Europese Commissie de volgende simpele vraag:


Roken en Discriminatie


De Europese Unie heeft waardevolle anti-discriminatiewetgeving opgezet.


Zou een personeelsadvertentie zoals onlangs gepubliceerd in Ierland (waar een rookvrije werkplek bestaat), met als kop ‘Rokers hoeven niet te reageren’ in strijd zijn met deze wet?

EU anti-discrimination law (Directives 2000/43/EC and 2000/78/EC ) prohibits discrimination on grounds of racial or ethnic origin, disability, age, sexual orienation and religion and belief in employment and other fields.


A job advertisment saying that “smokers need not apply” would not seem to fall under any of the above mentioned prohibited grounds of discrimination.


The Commission strongly supports banning smoking in workplaces as a measure to protect smokers’ and non- smokers’ health. It has also the indirect impact of helping people to stop smoking.

Een anti-discriminatiewet (Richtlijnen 2000/43/EC en 2000/78/EC) verbiedt discriminatie op grond van ras of ethnische herkomst, handicap, leeftijd, sexuele gerichtheid en religie en geloof op het gebied van werkgelegenheid en andere terreinen.


Een personeelsadvertentie met de tekst ‘Rokers hoeven niet te reageren’ lijkt niet te vallen onder een van de bovenstaande gronden met betrekking tot discriminatie.


De Commissie ondersteunt sterk het de bestrijding van roken op werkplekken als maatregelen om rokers en niet-rokers gezondheid te beschermen. Het indirecte effect is dat het mensen helpt te stoppen met roken.


Tenzij we roken als een handicap gaan beschouwen hoeven we van de Europese Commissie dus geen steun te verwachten. Óf de discriminatie moet dergelijke zware sociaal-economische effecten hebben dat een ander artikel in werking treedt: Het integreren van de uitgeslotenen. En dat zal met een dergelijke opstelling slechts een kwestie van enkele jaren zijn.


Hoe zou de reactie zijn geweest op een advertentie ‘Niet-rokers hoeven niet te reageren’?

The following letter doesn’t show that the EC is really serious about fighting for the right on employment for all European citizens. Unless smoking is considered as a disability, smokers will eventually end up by this policy as a secondary class citizen who will need to apply for another EC program: Integrating the Excluded.

Following this reasoning, employers may as well state that ‘Non-smokers and anti-smokers need not apply‘?


We are not surprised that so many citizens, when really asked for, have voted against the European Union last year. Although the EC’s lip service talks about being social, their real-time actions don’t show that.
