Rokers dagen ministerie voor de rechter

Het is heerlijk om de laatste tijd zoveel berichten te rubriceren onder de categorie ‘Rokersverzet’. Het zou ook wel tijd worden!


Waar in de VS rokers het massaal laten afweten en alles gemoedelijk slikken, begint het verzet in West-Europa goed op stoom te komen. We berichtten al eerder dat er veel verzet is onder Engelse pub-eigenaren en rokers. Maar wat we toen berichtten is nog niet alles. Afgelopen vrijdag werd formeel bekendgemaakt dat de organisatie freedom2choose bij het Engelse gerecht een klacht heeft ingediend tegen het Engelse Ministerie van Volksgezondheid. De rokersrechtengroep stelt dat de nieuwe wetgeving ingaat tegen het recht op privacy en strijdig is met het burgerrecht op het vreedzaam genot van bezittingen. De groep wordt gesteund door soortgelijke groepen in Ierland, Wales en Schotland.


Forces Nederland heeft al lange tijd contact met deze groep en stemt haar acties ook met hun af. We waren bijvoorbeeld uitgenodigd om hun acties met onze aanwezigheid te ondersteunen. Helaas is ons actieschip niet zeewaardig en moesten wij dat afzeggen. Wij bekijken nu welke ondersteunende acties wij voor hun op 1 juli, tijdens onze eigen Kruistocht tegen het Rookverbod, kunnen bedenken.


The pressure group Freedom2Choose is planning to lodge papers at the Royal Courts of Justice in London seeking a judicial review.


The group says the ban amounts to injustice and erosion of freedom and personal liberties.


Their legal challenge is based on the contention that it violates human rights laws.


These include a breach of Article 1 of the First Protocol of the European Convention on Human Rights which guarantees the right to the peaceful enjoyment of possessions.


Freedom2Choose also says the new laws are an “unjustifiable” infringement of the right to respect for privacy under Article 8 of the convention.


The group says: “This will be a legal test case with significant wider public interest.”
