Rokers New York starten rechtszaak
Rokers laten zich niet langer meer gedwee de wet voorschrijven en gaan terugvechten. Namens alle New Yorkse rokers start N.Y.C. CLASH een rechtszaak tegen het stadsbestuur van New York en tegen de staat New York. Beide overheidsorganen hebben kortgeleden algemene rookverboden voor de horeca ingesteld.
We will argue that the anti-smoking laws:
- Are unduly vague in violation of the Due Process clauses of the Fifth and Fourteenth Amendments;
- Are overly broad in violation of the First Amendment;
- Violate the Equal Protection Clause of the Fourteenth Amendment;
- Violate the Privileges and Immunities Clause of the Fourteenth Amendment; and
- Violate the First Amendment by impinging upon the rights of freedom of association, expressive speech and assembly.
