Rechter wijst claim tegen tabaksindustrie af
Een poging van de familie van een aan kanker gestorven Spaanse roker om €660.000 aan schadevergoeding te vangen van een tabaksfabrikant is gisteren door een rechter afgewezen.
Opvallend is de inhoud van de uitspraak:
“Het causale verband tussen de kanker van de man en zijn roken is niet onomstotelijk bewezen; roken is een vrijwillig gekozen gedrag; tabak is een legaal product en er staan al 20 jaar waarschuwingen op de verpakking van het product.”
Europese rechters hebben blijkbaar toch een duidelijk andere opstelling op dit gebied dan de Amerikaanse…
The ruling by the Olot Court coincides with other previous decisions by stressing two points as grounds for rejecting the case: the lack of a proven causal relationship and the existence of widespread information with respect to smoking as a risk factor.
In this respect, the Court ruling stated that ‘the causal relationship between cigarette consumption and the disease suffered has not been certifiably proven’. Likewise, it indicates that ‘smoking is a voluntary act’ and that ‘it is public knowledge that tobacco is a legal substance, and cigarette packs have borne health warnings for more than twenty years.’ In addition, the ruling emphasises the information to this effect publicised in all the media.
Finally, the decision establishes that ‘the preparation and distribution of tobacco are legal activities, undertaken with scrupulous fulfilment of all the administrative requirements’, and that that ‘the defendant has complied with all health regulations in effect’.
To date, Altadis has been absolved in the thirteen individual tobacco-related lawsuits filed against it in Spain and France.
