Als er maar geen tabak in zit…

Er is een nieuw gat ontdekt in de anti-roken wetten in de VS: sigaretten die geen tabak bevatten vallen niet onder die wetten….


In de tekst van de wetten wordt steevast verwezen naar tabak als ingrediënt. Als dat er niet in zit is een bar of restauranteigenaar dus niet in overtreding. En de controleurs weten het verschil volgens de overheid.


Niet altijd volgens dit korte berichtje uit Delaware…


Maar wat zullen de anti-rokers er over zeggen?  Als ze in een restaurant zitten en iemand steekt een ‘herbal cigarette’ op, worden ze dan ook gestoord? Ze ruiken hetzelfde blijkbaar. Diezelfde mensen(?) die zich storen aan rook achter het glas van een TV-scherm moeten wel in een identiteitsconflict komen… Zijn ze nu anti-rook of anti-tabak??????


PARKER: This might look illegal…but it’s not. Bull Dozers Saloon owner Frank Infante says it’s completely legal to smoke in his bar…as long as the cigarettes have no tobacco. He knows the law word for word.

FRANK INFANTE: Smoking is the lighting, or burning of a cigarette, cigar, pipe or any other substance that contains tobacco. These contain no tobacco. This whole law is about tobacco.

PARKER: Infante’s claim that he only lets customers smoke tobacco-free cigarettes hasn’t stopped state inspectors. He’s been fined 850 dollars so far.

FRANK INFANTE: When we went to court I asked him what he saw and what they saw was this. This is a non-tobacco, legal product that I am allowed to use here.

PARKER: State officials admit non-tobacco cigarettes don’t violate the smoking ban…but say inspectors are trained to know the difference.

KEVIN CHARLES: The packs themselves whether it be a tobacco cigarette or an herbal cigarette look very similar. There is a difference in the odor and that would be what we’re looking for.
